The plea for temporary bail is unlawful because the CM is not currently being held in custody, as stated by ASG Raju, who brought attention to the fact that the SC order states that bail is only available if the individual is in prison.
Additionally, the ED added that Kejriwal had concealed information regarding the nature of the medical examination that he is required to go through, and that he had submitted a plea to the Supreme Court that was very similar to this one.
Furthermore, the ED raised an objection, arguing that a trial court does not possess the inherent right to release a person without complying with Section 45 of the Prevention of Money Laundering Act. This is a prerogative that is reserved for the High Court and the Supreme Court.
On May 10, the highest court in the land gave Kejriwal a 21-day temporary release, which would expire today, so that he may campaign for the Lok Sabha elections.
